ORDER GRANTING DEFENDANT’S MOTION TO DISMISS FOR FAILURE TO PROSECUTE

This matter is before the court on Defendant’s Motion to Dismiss for Failure to Prosecute. Plaintiffs’ counsel withdrew by Order entered on February 9, 2004. Pursuant to DUCivP 83-1.4(b), Plaintiffs had 20 days from the entry of that Order to either obtain new counsel or to appear pro se. To date, Plaintiffs have failed to obtain new counsel or to appear pro se.

Defendant moves to dismiss for failure to prosecute. Plaintiffs failed to respond to the Motion. Therefore, pursuant to Fed.R.Civ.P. 41(b) it is

ORDERED that Defendant’s Motion to Dismiss for Failure to Prosecute is GRANTED and this case will be DISMISSED with prejudice.
