On December 24, 2003, the United States Magistrate Judge filed a Recommendation that Plaintiff’s Motion to Reopen the Arbitration Award be denied, and that Defendant’s Motion to Confirm the Arbitration Award, to Enter Judgment on the Award, and to Dismiss the Complaint be granted. [Doc. #21]. Plaintiff filed a timely Objection to the Recommendation [Doc. #23], and Defendant filed a Response to Plaintiff’s Objection [Doc. #24].
Having reviewed the Recommendation, Plaintiff’s Objection, and Defendant’s Response, it is determined that the Court accepts the Magistrate Judge’s Recommendation in its entirety. For the reasons stated in the Recommendation, IT IS ORDERED that Plaintiff’s Motion to Reopen the Arbitration Award be DENIED, and that Defendant’s Motion to Confirm the Arbitration Award, to Enter Judgment on the Award, and to Dismiss the Complaint be GRANTED.
