2. The motion for summary judgment filed by defendant is granted for Counts I, II, III, VII, XI, XV, XIX, XXVI, XXX, XXXIV, XXXV, XXXVI, XXXVII, XXXXVIII, and judgment is entered in favor of defendant against plaintiff on these Counts.
