STIPULATION FOR DISMISSAL OF PETITION FOR ORDER COMPELLING ARBITRATION AS TO LISA HYMER AND TOM LONESKY
SAMUEL CONTI, United States District Judge

It is hereby stipulated by and between Petitioners and Respondents, Lisa Hymer and (“Hymer”) and Tom Lonesky (“Lonesky”), through their counsel of record that:

1. The Petitions for Order Compelling Arbitration as to Hymer and Lonesky shall be dismissed;

2. Petitioners and Hymer shall jointly initiate an arbitration proceeding before the San Francisco office of the American Arbitration Association on or before October 31, 2002 and shall use their best efforts to have the arbitration completed prior to January 31, 2003;

3. Petitioners and Lonesky shall jointly initiate an arbitration proceeding before the San Francisco office of the American Arbitration Association on or before November 30, 2002;

4. The parties hereto shall bear their own costs and attorneys’ fees in connection with the Petitions for Order Compelling Arbitration in the within action; and

5. The panics shall share equally the cost of the arbitration, subject to readjustment by the arbitrator in the award.
