1. Petitioner’s motion to withdraw his complaint should be construed as a notice of voluntary dismissal. This care should be dismissed without prejudice pursuant to Rule 41(a)(1) of the Federal Rules of Civil Procedure.

2. The Clerk shall transmit a true copy of this Order and the Order adopting the Findings and Recommendation of the United States Magistrate Judge to all parties.
